1818 John W Staton and Mary Thompson were married on January 6 in Rutherford County, North Carolina. [1] [2]

Documents from the estate of John W Staton are in file #428. The documents span years 1838 to 1847. [3] [4]

1838 Mary Staton petitioned the Greenville, South Carolina court on May 13 to sell perishable crop from the estate of John W. Staton, who died after March 1, last. [5] [6]

1840 The administration of the estate of John W Staton by Mary Staton was recorded on September 7. The remaining sum of $753.06 was to be distributed among a widow and nine children. [7]

1847 Widow Mary Staton and their children were named in probate records in Greenville, South Carolina. [8] [9] [10] Walton Staton was named as a "next friend" of the minor children. [11] John Hodge purchased land from the estate from widow Mary Staton. The land was on the north fork of Saluda River adjoining land of James Staton and Walton Staton.

The petition of Jno W Hodges showeth that whereas he has purchased at Sheriff's sale of said disrtict all the interest and claim of Mary Staton of in or to the real estate of her deceased husband John W Staton (being one third part thereof) which will appear on reference to the conveyance made to me by David Hoke Sheriff of said district and whereas said land is now occupied by others so that your petitioner cannot without difficulty obtain his due portion of the … your petitioner thereupon prays that a summons on partition … The following is a correct statement of the heirs at law of said dec'd, viz Mary Staton the widow whose share your petitioner owns. The following are the names of the children within this state viz:
1) Silas Pace and wife Evelina. Residents of Henderson County, North Carolina: 2) Benjamin Staton (John W Hodges assignee), 3) Joseph B Staton, and 4) Rubin Staton. Minors under age: 5) Elijah T, 6) John A, 7) Trulove, 8) Anderson, 9) Ambrose.

1858 Two deeds were recorded involving the heirs of John Walter Staton. Both were Witnessed by T.V. Rhoads and James B Ward and were dated December 28.

1858 Benjamin W Staton, Rubin W Staton, Anderson R Staton, Ambrus P Staton, and Champness Forrester and wife Trulove sold land to Elijah T Staton, all of Henderson County, North Carolina. The land was 160 acres on the waters of Packlet in Henderson county, being part of the estate of John W Staton, deceased. Adjacent land was owned by Champness Forrest and Anderson Staton. The deed mentioned the old house, the Towas line, a grant to Samuel Gordon [Staton] bought by the said E. T Staton. Affirmed October 9, 1869. [12]

1858 Benjamin W Staton, Elijah T Staton, Anderson R Staton, Ambrus P Staton, and Champness Forrester and wife Trulove sold land to Rubin W Staton, all of Henderson County, North Carolina. The land was 188 acres on the waters of North Packlet in Henderson county, being part of the estate of John W Staton, deceased. Widow Staton was mentioned. [13]

Research Notes:

During the same period of time, there are deeds involving Walton Staton, perhaps the person named as "next friend" of the minor heirs. Perhaps this is Walton Staton, died 1849.

1839 Walter and Mary Staton and Charles B Southerlin sold 725 acres of land to Nancy Southerlin, all of Greenville District, South Carolina. The land was on beaver dam backwaters of the north fork of the Saluda River. The deed was executed about March 16. [37]

1840 Benjamin B Staton and wife Sarah sold land to Walton Staton on January 11, all of Greenville District, South Carolina. The land was on the Saluda River. Witnessed by D.D. Keer and William Metclf. [38]

1840 John Watson sold land to Walton Staton from the estate of Jacob Black, both of Greenville District, South Carolina. The land was on fall creek on the north side of the Saluda River. [39]

1840 On October 8, Walton Staton, Squire Morgan, and Daniel Pace chose James Pickett, Jefferson Barton, and John Watson to settle a land dispute. The land was on Fall Creek of the north fork of the Saluda River. [40]

1841 Walton Staton purchased land from Duncan and Wizetta Terry. [41]
